La situación financiera actual de la CJPPU y la proyección presentada como anexo al

anteproyecto, a la luz de cálculos actuariales realizados con el apoyo del Instituto de

Estadística de la Facultad de Ciencias Económicas y de Administración (IESTA), tienden a demostrar la inviabilidad de la CJPPU con la aplicación de medidas exclusivamente de carácter paramétrico, que no solucionan la realidad económica ni financiera de la Institución, ni a corto ni a largo plazo, al no generar ingresos inmediatos para paliar la apremiante situación, ni sostener un equilibrio económico financiero a largo plazo sin asistencia financiera del Estado.

¿Por qué el Estado tiene la responsabilidad de brindar asistencia a la CJPPU?

  • Porque el Poder Ejecutivo es responsable de coparticipar en la dirección de este instituto previsional.
  • Porque el déficit operativo anual fue dado a conocer públicamente a través de sus estados financieros, y los gobiernos de distintos períodos no la atendieron.
  • Porque así lo establece el artículo 67 de la Constitución.

¿Por qué se requiere una asistencia financiera del Estado sin demoras?

Porque las reservas que tiene este instituto generan recursos (renta) y éstas se liquidan mes a mes para poder cubrir el déficit económico. Cuanto más tiempo se demore el Estado en brindar asistencia financiera a la CJPPU más activos se siguen liquidando y menores recursos propios puede generar la institución (menor renta), por lo que la ayuda económica que se requiere para cubrir el déficit mensual será mayor.

¿En qué se diferencia la CJPPU al resto de las Cajas Paraestatales y Estatales?

  1. La CJPPU y Caja Notarial son los únicos institutos previsionales que no reciben aportes patronales.

Los aportes personales de los escribanos, Montepío, son facturados y cobrados a la sociedad, y los aportes patronales de las empresas que aportan a Caja Bancaria o BPS transfieren ese costo a la sociedad a través de distintos bienes y servicios que prestan.

Los paratributos que abonan los usuarios de servicios profesionales de la CJPPU, que se asocia al aporte patronal de los profesionales ajustado por un índice diferente al de los salarios, no tiene relación alguna con los aportes de los profesionales, y fueron reducidos en forma inconstitucional por la Ley de Presupuesto Nº 19924 del 18/12/2020 sin contraprestación o financiamiento alguno por parte del Estado.

  • Todas las Cajas a excepción de la CJPPU y Caja Notarial reciben asistencia financiera del Estado para pagar pasividades y otras prestaciones.
  • De acuerdo al cuadro 5.1 del Informe de Diagnóstico de la CESS – Jubilación máxima – la CJPPU se encuentra en la posición más baja de todo el Sistema Previsional después del BPS.
  • El sistema de aportes de la CJPPU se efectúa en base a una escala de sueldos fictos progresional que impide aportar en categorías más altas desde el inicio o cualquier momento de la historia laboral. Los titulares de Unipersonales que prestan servicios no profesionales tienen amparo jubilatorio en el BPS realizando aportes en base a una escala de sueldos fictos con total flexibilidad. El resto de trabajadores amparados por BPS y otros institutos previsionales realizan aportes por ingresos reales.
  • Los profesionales que tienen la obligación de aportar a la CJPPU por desarrollar una actividad liberal o independiente representan un poco más de la mitad de los aportes directos, y los profesionales que realizan aportes en forma voluntaria por estar ejerciendo una actividad exclusivamente en relación de dependencia, también pueden haber tenido períodos de actividad mixta a lo largo de su historia laboral por lo que continúan cotizando para no perder lo aportado y tener derecho a una jubilación complementaria y a ejercer su profesión en forma liberal cuando deseen.

¿Por qué algunas propuestas del Directorio de la CJPPU convenidas con autoridades del Poder Ejecutivo (grupo de trabajo conformado por representantes del MTSS, OPP y MEF) que se encuentran incluidas en la denominada “Ley Exprés” son inadecuadas y contravienen los principios de igualdad o justicia intrageneracional e intergeneracional consagrados en la Constitución?

Tasa de aportación. La propuesta de aumentar la tasa de aportación a la masa de activos haciendo caso omiso a las proyecciones actuariales con escenarios de sensibilidad en el cual se explicitan cambios de comportamiento de los afiliados deviniendo una situación deficitaria mayor a la actual es un acto irresponsable. Se omite atender también las Estadísticas del instituto expuestas en las Memorias anuales de la CJPPU que dan cuenta de la diversidad de profesiones que ampara la Caja y el deterioro en el avance de la carrera de categorías del colectivo en los últimos años. Teniendo en cuenta una carrera de aportes de 10 categorías (aportes en función de escalas de sueldos fictos) en la última Memoria 2023 surge: “Se puede observar que entre 1° y 2° categoría se acumula aproximadamente un 46,86 % de los afiliados activos llegando a un acumulado del orden del 70% hasta la 4° categoría.” Teniendo en cuenta que la categoría 2ª es aquella partir de la cual se puede optar por no seguir avanzando y que esos aportes representa el 36% de la cuota correspondiente a la categoría máxima a la que podrían llegar para alcanzar una mejor jubilación, la realidad da cuenta de la dificultad que tienen los trabajadores de profesiones universitarias para mantenerse amparados al sistema previsional actual.

Sueldo básico de jubilación. Se propone un sistema de cálculo para afiliados profesionales que establece el promedio de una cantidad de años de aportes superior a la actual sin modificar el modelo de carrera obligatoria por la cual solo se permite ascender en las categorías de aportes cada tres años en el sistema actual y cada dos años para la nueva carrera de 15 categorías que se propone, significando una medida que tiende a disminuir aún más la futura pasividad del afiliado, teniendo en cuenta la reducción que se generará por la rebaja de cinco puntos porcentuales en la tasa de reemplazo que se propone, y sin contemplar la mayor cantidad de años de servicios que puede llegar a computar un afiliado al aumentarse la edad de retiro.

Empleados de la Caja comprendidos en su régimen. Correspondería se aplicara similares condiciones y parámetros establecidos para el cálculo de jubilaciones y subsidios por incapacidad para trabajadores dependientes en la Ley 20.130.

Carrera de categorías. Considerando cambios que se proponen en el Sueldo Básico Jubilatorio, y con el objetivo de recaudar mayores ingresos para la Institución sería justo y conveniente permitir el libre ascenso y descenso de categorías, sin modificar lo dispuesto respecto a la detención hasta determinadas categorías.

Período de transición – regla de proporcionalidad. Los profesionales se encuentran consagrados con igualdad de derechos que los trabajadores amparados por el Sistema Previsional Común aprobado por Ley 20.130 del 02/05/2023, por lo que el procedimiento de convergencia del sistema actual al futuro rige para las causales jubilatorias que se verifiquen dentro de un plazo de veinte años, a partir de su vigencia, por lo que la regla de proporcionalidad o transición entre distintos regímenes, correspondería que se aplique en la misma gradualidad establecida en la Ley 20.130 (art. 17 – porcentaje de incidencia en el beneficio total).

Contribución a cargo de jubilados y pensionistas. La prestación de carácter pecuniario a favor de la Caja que pretende gravar Jubilaciones y Pensiones vigentes y futuras es otro impuesto que se pretende imponer a los pasivos de la CJPPU, aparte del IASS, contraviniendo además el principio de igualdad y justicia establecido en la Constitución y a lo establecido en la Ley 20.130 Sistema Previsional Común. Podría, a lo sumo, establecerse reintegros por parte de jubilados y pensionistas que recibieron prestaciones por encima de lo mínimo legal otorgadas y mantenidas por Directorios de la Caja en forma improcedente, durante la misma cantidad de tiempo que gozaron de esa partida extraordinaria.

Conclusiones finales

El anteproyecto de Ley presentado por la CJPPU opta por el aumento en la tasa de aportación de activos -a pesar de estadísticas e impactos negativos proyectados por el modelo actuarial sensibilizado dados a conocer-, extensión de edad mínima de retiro, rebaja de beneficios por tasas de reemplazo, aumento de años para el cálculo del Sueldo Básico Jubilatorio -sin tener en cuenta ni modificar el sistema de aportes (escala de sueldos fictos progresional) que impide al afiliado aportar en la/s categoría/s más alta/s durante su historia laboral-, y detracción de importes de las pasividades. Con todos esos perjuicios a los profesionales se desestimula la afiliación de los nuevos profesionales, la continuidad de aportes de los afiliados activos voluntarios y los aportes en categorías más altas, ya reducidos.

El anteproyecto de reforma de la CJPPU es injusto y desigual, vulnera derechos adquiridos y en proceso de adquirir de profesionales obligados a aportar a este instituto, evadiendo el Estado la responsabilidad de reconocer la mala gobernanza de la cual participó y la responsabilidad constitucional de respaldo a los sistemas de seguridad social.
